  • Domestic violence injunction: These are injunctions by spouses, ex-spouses, relatives, anyone else who has lived together in the same dwelling as a family unit or any persons who are parents of a child in common, regardless of whether they have been married. With the exception of persons who have a child in common, the family household member must be currently residing or have resided in the same single-dwelling unit in the past.
  • Repeat violence injunction: This injunction can be filed by anyone so long as the person filing is the victim of repeat violence or is the parent or guardian of a minor child living at home who is the victim of repeat violence.
  • Dating violence: According to Florida Statute §784.046, this means violence “between individuals who have or have had a continuing and significant relationship of a romantic or intimate nature.” The law looks at three factors in determining whether a “dating relationship” exists:
    1. A dating relationship existed within the past six months
    2. The relationship is characterized by the expectation of affection or sexual involvement between the parties and
    3. The frequency and type of interaction between the parties must have included involvement over time and on a continuous basis during the course of the relationship
  • Sexual violence: This can be filed by the victim of sexual violence or by the parent or legal guardian of a minor child living at home who is the victim of sexual violence.

Note: Florida Statute §784.046 prohibits the assessment of filing fees for injunctions for protection against repeat violence, dating violence and sexual violence.
