Injunctions


Whether you have had an injunction for protection filed against you or you are seeking to file an injunction for protection against someone else, the process can be an extremely difficult and scary one.   1. Domestic Violence Injunction: These are injunctions by spouses, ex-spouses, relatives by blood or marriage, anyone else who lives or has lived together in the same dwelling as a family unit, or any persons who are parents of a child in common, regardless of whether they have been married. With the exception of persons who have a child in common, the family household member must be currently residing or have resided in the same single dwelling unit in the past.
  2. Repeat Violence Injunction: This injunction can be filed by anyone so long as the person filing is the victim of repeat violence, or the parent or guardian of a minor child who is living at home, who is the victim of repeat violence.
  3. Dating Violence: This means violence between individuals who have or have had a continuing and significant relationship of a romantic or intimate nature. Three factors or consideration in determining whether a “dating relationship” existed:
    1. Dating relationship existed within the past 6 months,
    2. Relationship is characterized by the expectation of affection or sexual involvement between the parties, and
    3. The frequency and type of interaction between the persons involved in the relationship must have included that the person have been involved over time and on a continuous basis during the course of the relationship.
    4. Note: Dating violence shall not be created between the parties where contact has been “casual” or “ordinary.”

  4. Sexual Violence: This is filed by the victim of sexual violence, or the parent or legal guardian of a minor child who is living at home, who is the victim of sexual violence.
  5. Please note that F.S. 784.046 prohibits the assessment of filing fees for injunctions for protection against Repeat Violence, Dating Violence, and Sexual Violence.
