All too often, it becomes clear that incarceration is not the answer for cases of domestic violence. Fortunately, the Office of the State Attorney and Fifth Judicial Circuit Court offer programs to eligible defendants in which the prosecution of a defendant’s case can be deferred while the defendant attempts to complete a batterer’s intervention program or other appropriate program as specified by the State attorney. If successful in completing the prescribed program and meeting all the conditions thereof, the defendant may be able to have his or her charges dismissed.

Often it is important to motion the Court for the setting of a reasonable bond so that the accused person can be released to work and provide for his family. Other times, it is necessary to attempt to modify the conditions of the bond so that the accused person can return to his home.
